Planning & Zoning Meeting
April 12, 2011
 
Chair Wicker opened the Planning meeting at 7:03 p.m.  He called for any corrections or additions to the minutes.  Chuck Froehling/Supervisor Kuechle made a motion to approve the minutes.  Motion carried.
 
Old Business: 
Adolph Easement - John Adolph was present.  The contract between the City of Kimball/ Maine Prairie Township and Mr. Adolph was reviewed and signed.  Clerk Harff will have her signature notarized give it back to the City for recording.  Clerk Harff asked who would be in charge of holding the deposit.  It was decided that the City will be in charge of that. 
 
Building Inspector Contract – After review and discussion, the contract was signed to be renewed in one year.  The question was brought up about inspecting gas furnaces.   Albers stated that he does inspect it in new homes but not if someone changes their heating system.  The board will review how inspections can be enforced after the inspection permit is issued.
 
Jody Mackereth – Was not present for the meeting.  He is looking at opening a new pit in the old Mid MN site.   
 
New Business: 
 
Karl & Carol Krippner came before the board requesting a Certificate of Compliance.  They were asking to be able to split their 40 acres into two parcels; 10 acres with the residence on one and 30 acres of pasture/ag land on the second one.   The board made the Krippner’s aware that the 30 acres could not become a buildable lot.  Another concern is this split would make the 30 acres land locked.  The Krippner’s explained they would be selling the 40 acres to one person but in order to get the mortgage, they need to do the split.  It was explained if the new owners would want to sell the 30 acres; an easement would be required to have access to the land.  The land is in Sec 27, parcel #20.11681.0030.  Supervisors Wicker/Kuechle made a motion to allow the split.  Motion carried.
 
Neil Willgohs came before the board interested in purchasing the Paul Arnold property in zoning district R5.  His wife has a massage business in the cities and he has a Mechanical Design business in Battle Lake.  They would like to move to Kimball along with their businesses.  Chuck Froehling checked with the county and her business is considered a “home extended” business and his business is considered a “Home Occupation” business.  Both of these businesses would require a Provisional Use one time permit.  If Neil would hire an employee, he would need to get a conditional use permit because it would then become a “Limited Use” business.  That would require a hearing.   He is looking at building a new shed for his business.  The board asked about the size of the shed.  Neil explained it would be 12 foot high side walls.  The board explained that they would need to come before the board before a building project could take place.  Supervisor Loewen made a motion to allow these businesses.  After discussion that the land was not purchased yet, Loewen withdrew his motion.
 
Reggie Fraley from Alpha Development came before the board to inform the board that he is representing Chad and Jeff Kraemer of K B Company.  This company is negotiating a transaction with the Nystrom family to assume the lease of Randy Kraemer with the Nystrom gravel pit.  The lease is going to be amended and extended for 10 years to K B Company.  He has spoken to the county and the county registered this gravel pit in 2004, no permit was ever issued, it was grandfathered in.  Registration number 2004-043 in the Stearns county records.  A copy

of the old lease was given to the township and when the new lease is modified, a copy of that will be shared.  Fraley explained the equipment will be sold at auction.  The pit would be cleaned up with nothing to be buried.  The size of the pond would not be increased.  Supervisor Kuechle asked if they are aware of the road restrictions once the trucks leave the pit.  It was understood they can’t head north on 93rd or west on Powder Ridge road with a load.
 
Gary Grossinger – came before the board explaining most of the taxes were lowered except for Agriculture, Gary also explained the Green Acres credit will be increasing so there will not be as much a benefit for the farming community.   Gary stated that there are only 2 people down to come in to the Board of Appeal & Equalization meeting on Tue. April 19th.  Supervisor Kuechle will be out of town that day. 
 
Jason Spaulding – came before the board asking for permission to put his irrigation pipeline under Dellwood road.  He is looking at incasing the 6” irrigation pipe into a 10” pipe.  Discussion went to depth of pipes, underground wires, and proper signage on the road during the work process, materials used for repairing the road and compact the surface when ground is replaced.  Supervisors Loewen/Kuechle made a motion to allow the irrigation pipes by digging up Dellwood Rd.  Motion carried.  Clerk Harff was directed to draw up a contract with the items discussed included and to email it to the supervisors for their approval.  Spaulding was asked to come on April 19th at the Board of Appeals meeting for signatures.  Spaulding would like to get started around the first or second week of May. 
 
Supervisors Loewen/Wicker made a motion to approve the permits.  Motion carried.
