Planning & Zoning Meeting
June 8, 2010
 
Chair Wicker opened the Planning meeting at 7:03 p.m.   He called for any corrections or additions to the minutes.  With none, Loewen/Kuechle made a motion to accept the minutes as presented.  Motion carried.
 
Chair Wicker called for old business: Sarah Yozamp – Ron Albers said he never made it out to look at the sky light in their roof.  Tabled
 
Richard Fuchs came before the board requesting a certificate of compliance.  He is requesting a split off  26.2 acres (homestead) from his 125 acres.  The 96.1 acres would remain agriculture.  His reasoning is he is trying to get his estate set up for his children.  The land is zoned A40 in section 6.  This land is situated in both Maine Prairie and Luxemburg townships.  Supervisors Wicker/Kuechle made a motion to accept the split and issue the certificate of compliance.  Motion carried.
 
Chair Wicker called for new business:  Mary Lou Spencer is requesting a split up of her land by 100th Ave on the North side of Powder Ridge.  Kuechle said that he is talking to the county as to what she could do.  The land is zoned A40.
 
Glen Schindele is requesting a certificate of compliance for a land exchange.  Schindele explained when he had the survey done, the property lines were off.  They are requesting to do a property exchange of 5.2 acres with the John Frischmann family.  John Frischmann was present.  Their lawyer will be doing a quick claim deed.  Supervisors Kuechle/Loewen made a motion to issue the certificate of compliance for the land exchange.  Motion carried.
 
                                Karen & Richard Chapman Road Variance Hearing
Chair Wicker opened the hearing for the Chapman’s at 7:20 p.m.  Karen and Richard Chapman want to add a 10X17’ addition onto their cabin on Carnelian Lake Rd.  They need a road variance; 63’is required and they can only meet 40’which is what their cabin is at now.  The survey was presented to the board and their home is in compliance for side setbacks but their neighbor, Kathy Johnson’s, cabin is encroaching onto the Chapman’s property.    Chapman’s house addition will be built even with the rest of their home.  Supervisors Loewen/Wicker made a motion to close the public hearing.  Motion carried.  Discussion was they met all other setbacks, and it would not protrude to obstruct visibility for their neighbors.  Supervisors Wicker/Kuechle made a motion to issue the road variance.  Motion carried. 
 
Chair Wicker explained that McCrossan’s withdrew their interim use permit hearing.  The company ended up using another site. 
 
                                            Duane Fruth Road Variance Hearings
Chair Wicker opened the Fruth hearing at 7:30 p.m.  Duane is requesting two variances from two different roads.  The first request is to build a 30X50X10’ shed 17’ from a platted road encroaching the right of way by 46’.  The road shows up on the plat where the road should be.  If used as the traveled
road, it would be encroaching other resident’s homes and sheds.  The county requires a variance from

the platted road.  The existing traveled road was moved by the residents for convenience purposes.  Fruth moved the shed from his original plans, away from his neighbor’s view and lowered the sidewall height.  That way he saved his trees.  The shed would meet the setbacks from the existing traveled road and all other setbacks will be met in lot 1 & 2.    Supervisor Loewen/Wicker closed the public hearing, carried.  The discussion was that the existing road should be considered as the road traveled.  Supervisor Loewen/Kuechle made a motion to accept the road variance for his shed.  Motion carried. 
 
Chair Wicker opened the 2nd hearing for Duane Fruth.  Duane is requesting to put up a 30X30X10 shed in Government Lot 1 Tract A.  This would encroach the platted road by 47’and the existing traveled road by 31’.  The lot was viewed by Greg Bechtold from Environmental Services because of the wetland close to the area.  Their suggestion was to stay away from the wetland.  This would force Fruth to put the shed to close to the traveled road.  Supervisors Loewen/Wicker made a motion to close the public hearing, carried.  Discussion was that the traveled road on the Fruth property and was never meant to be a through road but was to be just a road to the Fruth property.  The concern was if the township wanted to make it a township road to meet township specs, the shed would be in the way.  Supervisor Wicker made a motion to accept this variance with the condition if the township would need to build a road there, the shed would be removed seconded it by Supervisor Kuechle.

                                  Reconvene Road Vacation Hearing for Schindele Family
 
Chair Wicker reopened the hearing for the road vacation.  The Schindele family was asked to get a survey done for the location.  Glen presented the survey to the board explaining the road and property lines were off, thus the previous action by the board was necessary to do a quick claim deed to exchange properties with the Frischmann family.  He also presented the legal utility and road easement drawn up to protect the Frischmann property.  The survey shows the road to be vacated is considered Lot C.  Supervisors Wicker/Kuechle made a motion to accept the road vacation.  Motion carried. 
 
Permits were presented:  Supervisor Wicker/Chuck Froehling made a motion to approve the permits.  Motion carried.
 
Supervisors Loewen/Wicker made a motion to adjourn.  Motion carried
