Planning & Zoning Meeting
March 4, 2010
Chair Wicker opened the Planning meeting at 7:05 p.m. He called
for any changes or additions to the minutes. Supervisor Chuck
Froehling/Unterberger made a motion to approve the minutes. Motion carried.
Old business called for: With none, new business was called for.
Glen Schindele, Lori Doering, and Robin Salmala were asked to come before
the board again. Clerk Harff found statutes that would have an impact
on their hearing that would need to be cleared up first. DNR needs to
have 15 day notification before the vacation hearing can be scheduled.
Yet the township has 30 days to answer the petition. The petition
presented previously did not explain the footage of the road they want to
vacate, why they wanted to vacate and the signatures were not voting
residents of the township as required by law. The Schindele’s were
going to redo the petition so the process can move forward. Supervisor
Loewen would like to consult legal advice. The road to vacate would
begin at lot #7 and go East to the end of lot #8. Glenn Schindele
explained that he owned land surrounding the Frischmann home. The
requirements would be: to legally record an easement for the Frischmann’s
and to leave the road as is. When the new petition comes in, Clerk
Harff will proceed with the DNR notice so the hearing can take place at the
April meeting.
Permitting was discussed. A review of the revised list of permitting;
it was suggested to remove re-roofing, cementing, leave in patios because of
impervious space needs to be checked, and remove small sheds under 100 sq ft
from Chucks list. The window permits will now require inspection by
Ron Albers to check for safety glass and if there is a need for egress
windows. A flat fee will be discussed with Ron. Noted that Tina
Dietrich would prefer re-roofing permitted because it changes their market
value. Market values are lowered with older shingles; they need to
know when the shingles are changed so the market values can be raised.
Kevin Johnson came before the board to request a variance hearing.
Johnson had been to the county and received a construction site permit but
needs a road variance. Kevin is requesting to put up a 20X24 foot
sleeping cabin on the East side of Carnelian Lake Rd which would encroach
the road setback by 30’. The land is in R5 zoning, the lot size is
169’wideX110’deep; a 50’ set back is required from the county but the
township ordinance #2 requires an 85’ setback from the road. Supervisor
Unterberger will check it out at the county. A hearing will go
forward at the April 13th meeting if one is needed.
Permits were called for with none, Supervisors Wicker/Loewen made a motion
to adjourn. Motion carried
