Planning & Zoning Meeting
October 11, 2011

 
Chair Loewen opened the Planning meeting at 7:05 p.m.  He called for any corrections or additions to the minutes.   Supervisors Wicker/Froehling made a motion to approve the minutes as presented.  Motion carried.
 
Old Business:  Margaret Douglass, sewer problems.  Douglass was present, has a cabin on Carnelian Lake Rd and the high water has caused issues with her sewer.  She had Bernie Miller draw up a plan to bore under Carnelian Lake Road so she can put her drain Field on the other side of Carnelian Lake Rd at an angle about 100’ away from her cabin.   The board was concerned for the newly tarred Carnelian Lake Rd.  Mike Couri from Couri, Mac Arthur, Ruppe Law Office was asked the proper way to move.  He explained an easement is not the right legal document; they draw up a License to do work such as digging into or under roads.  With a review of this document, Margaret asked if she could have her lawyer review it.  Couri explained she would be responsible for the cost of drawing the document up and recording fees at the county.  Supervisor Kuechle/Wicker made a motion to have Mike Couri draw up an acceptable document for both parties as soon as possible so the work can begin with the proper signatures in place.  Motion carried.  In the agreement, it was to have a $2500.00 security check to be held until the work is done and the road is inspected for any damage.  Mr. Couri will work with Ms Douglass and/or with her lawyer. 
 
With the information presented by the lawyer, Clerk Harff felt the Donnay/Yozamp tiling under 140th Street approved at the September 13th meeting, should also be a license not an easement.  With discussion, Supervisors Wicker/Kuechle made a motion to have Couri law firm draw up the legal document.  Motion carried.  Couri asked Clerk Harff to get a copy of the easement drawn up when the land sale took place along with the legal description.  Couri explained his wife, Karen, would also need to be included in the document. 
 
With no other old business, new business was called for.
 
Building Inspector – Clerk Harff explained to the board that she received a call from the State Department of Labor & Industry on October 11th explaining that Bldg Inspector, Ron Albers, had his license pulled for not having enough CEU (Certificate Education Units) credits.  Mike Fricke, explained that the township has 15 days to have a new inspector in place.  Clerk Harff was directed to get more information, check into other inspectors in the area, to see if the state will issue an extension of time, to contact Ron Albers to inform him of the call from Mike Fricke., and to get more information as to the fee schedule, and existing permits left open for inspection.  Supervisors Loewen/Kuechle made a motion to rescind Ron Alber’s contract as of October 11, 2011.  Motion carried.  Discussion: Bob Pike thought a building inspector was a good protection for the residents.  Mike Couri, Lawyer for Couri’s Law Firm, explained that the township would not be liable for any permits issued that were improperly handled.   Clerk was concerned that she received a Certificate of Liability Insurance from Albers every year, she could not understand how he could get insurance without proving recertification.   The decision was to stay with the adoption of the building code until Couri can see if the townships can un-adopt the building code.  Clerk Harff was asked to get a list of different building inspectors in the area for an October 20th Emergency meeting.  Clerk Harff will do the legal's for an emergency meeting.
 
County sent out a notice of a November 1st hearing for Flood Plain Changes and Feed Lot Changes in their Ordinance.  Clerk Harff was asked to bring this up at the October 20th meeting to see if someone can attend from the township.

Clerk Harff explained that she is setting up a hearing for Thomas Fenton on East Shore Drive for the November 8th regular meeting.  The papers given are if the board would like to go out and view the property.

Supervisors Loewen/Wicker approved the permits presented.  Motion carried
 
Supervisors Loewen/Kuechle made a motion to adjourn.  Motion carried.
