Planning & Zoning Meeting
August 9, 2011
 
Chair Loewen opened the Planning meeting at 7:05 p.m.  He called for any corrections or additions to the minutes.   Supervisors Wicker/Kuechle made a motion to approve the minutes as presented.  Motion carried.
 
Old Business:  Roger and Sandra Collins came before the board.  A letter was sent explaining they did not receive the proper permits for the addition of their screened porch in 2010.  After they went to the county, they thought they had met all the requirements.  The board was concerned that not following the proper procedure when others have been forced to; sends a wrong message.  Supervisor Wicker/Froehling made a motion to lower their fine to $500.00 because they did go through the county before it was completely done and they ceased work until the county approved the work.  Motion carried.  Building inspector, Ron Albers, will go out for the final inspection.
 
Mackereth Gravel Mining Hearing
Clerk Harff read the legal.  With no written comments, Jody Mackereth was asked to explain what he intends to do.  He explained the county had misinformed him stating that none of his property was within shoreland district.  Now he was being told the western half is under shoreland county control.  This upset Mackereth because he had spoken to the county before he purchased the land and they told him he would not have to come before the county for the gravel permitting process.   Mackereth explained to the board that he was only going to mine from the eastern part of the land and would put his shed up on the western section.  It was reviewed that Mackereth is reclaiming and selling the property south of Kimball.  With no comments from the people present, Supervisors Wicker/Kuechle made a motion to close the public hearing.  Motion carried.  Discussion was that the land was previously a gravel mining pit, a $25,000.00 bond will be required along with a reclamation plan, tree line, berm, dust and weed control are also required.  With those conditions Supervisors Wicker/Loewen approved the Conditional Use permit renewable every year.  Motion carried.
 
Clerk Harff asked what to do next, Garding Photography never replied to her letters.  She was sent three letters in two years requesting they get the proper permits for their sign and home business.  Chuck Froehling said that he would contact her before the next meeting. 
 
Thompson Insurance Representative, Ceasar Larsen requested a permit for a field approach.  Chuck Froehling explained if they are doing cementing or putting up bins, he has had no request for a permit as of yet.  Clerk Harff was asked to send them a letter explaining they would need a permit.  Discussion that 150th Street might require posting if they are going to be hauling large loads of grain.  Concern is that the township road is not a 10 ton road and any road not posted is assumed to be a 10 ton road.  Supervisor Wicker spoke with township lawyer, Mike Couri.  He explained that the township can enter into a legal agreement stating that if the road is damaged from truck traffic, it will be replaced by Thompson Insurance to become a 10 ton road. 
 
With many residents from Eldorado, Eclipse and 98th Ave in the planning and zoning was recessed.
 
The Planning and Zoning meeting was reconvened at 8:30 p.m.
 
Discussion was how does the township know if final inspection is done?  Froehling explained that there is a place on the permit that says final inspection and that is signed by the inspector.  Clerk Harff was asked to check with Roger Collins to see if Ron Albers signed off on their permit. 
 
Kim Hanson/Wayne Larson has a family pool coming off their outside patio.  Clerk Harff talked with the county about it and they need to have gates according to the county ordinances.  The permit shows that he has a permit for the cemented patio.  Clerk Harff was directed to call Ron Albers to have him inspect the pool  and to explain what needs to be done to bring it up to code. 
 
Discussion was what permits are renewable?  The decision was to wait until we get the MOU completed.

Permits were reviewed.  Supervisors Kuechle/Loewen made a motion to accept the permits.  Motion carried.
 
Supervisors Wicker/Kuechle made a motion to adjourn.  Motion carried.
