Planning & Zoning Meeting
December 14, 2010
 
Chair Wicker opened the Planning meeting at 7:05 p.m.   He called for any corrections or additions to the minutes.  Chuck/Supervisor Kuechle made a motion to accept the minutes as presented.  Motion carried.  Chair Wicker called for Old Business:
 
Clayton Johannes – Deb Becker came before the board representing Clayton requesting a Certificate of Compliance for a quick claim deed for 521’X33’ (.39 acres) on the North Side of Johannes property that is owned by Powder Ridge.  Becker is trying to get all the paperwork done so they can record the deed.  Johannes is an over the road truck driver and was not able to be at the meeting.  Becker said Johannes will come before the board when he wants to build his shed.  Supervisors Loewen/Wicker made a motion to move forward with the Certificate of Compliance.  Motion carried.
 
Mark Hesse – Hesse came before the board explaining the county told him that he first needs to get a road variance for his cabin.  The board was concerned if they would go through the variance hearing; he would still not be allowed to add a 2nd story because his cabin does not meet the setbacks for the lake or neighboring lots.  The board will table until they can have a special meeting on site with a representative from the county.
 
Harland & Ann Donnay hearing- Chair Wicker called the hearing to order asking the clerk to read the legal notice.  Wicker asked if there were any replies from the public.  Clerk Harff explained that she received a call just asking what it was about.  Robinson’s were not against the Used Car lot, just wondering what conditions would be applied concerned of the number of cars being allowed and disposal of used motor oil.  Harland explained that he was applying for a Used Car License and needed to get a Conditional Use Permit.  The land is zoned A80 requiring permitted usage of this type of business.  The county requires a maximum of 10 cars, no on street parking, meet the road setbacks and Donnay would be required to meet all the ordinances put forth from the county.  Wicker called for any question from the residents, with none, Supervisors Loewen/Wicker made a motion to close the hearing.  Motion carried.  The board discussion was the permit should not be transferrable if the land should be sold.  Supervisors Kuechle/Wicker made a motion to issue the Conditional Use Permit with the condition that it not be transferred to any future land owner.  Motion carried.  Clerk Harff was asked to give Harland a copy of the ordinances and sign policy. 
 
Powder Ridge Estates -Josh Hart came before the board requesting more information on how the road is expected to be built.  He purchased the land from Ken Zutz and had a copy of the plat with 5 separate lots and a wetland.  Hart explained that he had to get a bond for Stearns County to put the road in this spring.  Hart wanted to know the township requirements, does it need to be tarred, can it remain gravel, and does the township service it.  It was explained that the township does not accept the road until after 3 years to see how the road holds up.  Some members of the board felt they were opposed at accepting it at all because it is not a through road and with only 5 lots, it would not generate enough taxes to cover the costs.  The question arose that the township might be obligated to accept the road when they accepted the plat.  Another concern was the elevation, would a gravel road wash.  The board tabled this until it can check into it further.

 Jill Kraft will be removed from the agenda until further notice.  It appears that she might have sold the property and her question of homestead tax is mute. 
 
Karl Krippner called to question if he could split his land, sell his house with 10 acres and sell the remaining 30 acres.  It was explained that he could split his land but the 30 acres would not be a buildable site.  He understood that and the neighbors would like to buy it for hunting ground to attach to their land.  He was told he needed to get a survey and bring it to the county. 
 
Permits were called for.  Ron Albers was asked if he went out to check Harland Donnay’s deck and pool.  Albers has been on site but needs to know what should be charged for the after-the-fact permit cost and Harland was getting him the cost of the deck.  Albers explained it was a shallow pool with a 26X57’ deck half surrounding the pool.  The board decided to stay consistent, the board will add a $100 after-the-fact fine.  Supervisors Loewen/Wicker made a motion to accept the permits.  Motion carried. 
 
Ben Eder’s trailer has been put in.  It is not as big as permitted.

Supervisors Loewen/Wicker made a motion to adjourn.  Motion carried.
